The Process

What to Expect When You Work With Us

If you've just received a ticket, summons, or court date, you're probably feeling uncertain about what to do next. We get it. At XPolice Hamilton, our job is to make the process clear, manageable, and handled—so you can focus on moving forward.

Here’s how we guide you from first contact to final outcome.


Step 1: Reach Out

It starts with a free consultation. You tell us what happened, we ask the right questions, and we explain what your charge means—without legal jargon.


Depending on the paperwork you received, your charge will likely fall into one of these categories:

  • Part I Ticket (Minor offence): These include things like speeding, stop signs, or handheld device use. A court date isn’t automatic, but we can request one on your behalf if there’s a valid defence or issue worth fighting.
     
  • Part III Summons (Serious offence): These are more serious and always come with a court date. Common examples include stunt driving, careless driving, no insurance, or driving under suspension. The risks here can be much higher—big fines, licence suspensions, and even jail.
     

Our first job is helping you understand exactly what you’re facing and what your rights are.


Step 2: We Dig In

Once you hire us, we get to work right away. We request full disclosure from the prosecutor—this includes the officer’s notes, radar/lidar readings, video, and other evidence.

Every detail is reviewed by your paralegal and, where needed, by our retired police consultant. We look for errors in how the ticket was issued, procedural problems, or weak evidence that can be challenged in court.


Step 3: Your Strategy

After reviewing the disclosure, we sit down with you to explain the strengths and risks of your case. At this point, we lay out your options clearly:

  • Take the matter to trial and fight for a dismissal
     
  • Negotiate a resolution that avoids the most serious penalties
     
  • Raise legal arguments based on Charter violations or procedural unfairness
     

We don’t just offer a one-size-fits-all defence. We build the strategy around your goals, your record, and what matters most to you.


Step 4: We Represent You in Court

You don’t need to show up to every hearing—we attend court on your behalf and keep you informed at each stage.

Whether it’s negotiating with the prosecutor or presenting your defence before a Justice of the Peace, we act as your advocate. Our experience on both sides of the courtroom—legal and law enforcement—gives you a well-rounded defence you won’t find everywhere.


Step 5: Results and Next Steps

After court, we walk you through the outcome. We explain what it means for your driving record, insurance, and future. And if there’s anything else that needs to be done—like paying a fine, ordering a transcript, or even considering an appeal—we’re there to guide you.

This isn’t just a transaction. We’re with you to the end of the process—and beyond if needed.


Ticket Types We Handle

We defend all Highway Traffic Act, Provincial Offences Act, and MTO-related charges, including:


Minor Tickets (Part I)

  • Speeding under 49 km/h in zones 80 km/h or higher
  • Stop sign or red light violations
  • Seatbelt offences
  • Handheld device use
  • Fail to surrender driver’s licence, insurance, or vehicle ownership
     

Major Offences (Part I or III)

  • Stunt Driving
    • 50 km/h+ over the limit in zones 80 km/h or higher
    • 40 km/h+ over in zones under 80 km/h (e.g. residential or city streets)
    • Other forms such as burnouts, racing, or tailgating
  • Careless Driving
  • Driving Without Insurance
  • Driving Under Suspension
  • Fail to Remain
     

Other Provincial and Regulatory Offences

  • MTO and CVOR-related charges
  • Insurance Act offences
  • Building Code, Sewer Use By-law, and other regulatory infractions
  • Parking and licensing matters under municipal by-laws
